Projekt: The (in)determinacy of the requirement of consultation with indigenous peoples under the Brazilian legal system

Catarina Woyames is a PhD candidate at the Graduate School  "Society and Culture in Motion" and at the School of Law of the Martin  Luther University Halle-Wittenberg. Her thesis analyzes  opportunities and challenges of new technologies for the inclusion of  indigenous peoples in the democratic process in Latin America. Her  broader research interests include participatory democracy, digital  inequalities in Latin America, human rights, and big data. Following  undergraduate studies in Minas Gerais, Brazil, Catarina earned a  Master’s degree in International Public Law and European Law from  Coimbra Faculty of Law, Portugal. She was a visiting scholar at Paris  Pantheón-Assas, the Max Planck Institute for Comparative Public Law  and International Law in Heidelberg, Germany, and she was a fellow at  The Hague Academy of International Public Law. Amongst others, she  participated in conferences and workshops of the School of South  Governance at the Organization of American States (OAS), the Internet  Governance Forum (IGF) of the United Nations and the International  Workshop on Gender and Cybersecurity in Léon, Spain. Catarina is a  member of the Noncommercial Users Constituency (NCUC) of the Internet  Corporation for Assigned Names and Numbers (ICANN).

PhD Abstract

Originally, the requirement of consultation with indigenous peoples was conceived as an obligation of conduct related to property. Jurisprudence of international organs and some state practices however appear to suggest that consultation might be invoking aspects beyond property law. To shed light on this conflict of legal interpretations, the analysis there will be conduct of the requirement of consultation transgresses the issue of property rights and considers consultation also as a potential means to further self-determination, cultural integrity and equality. The research approach of the study is thereby twofold: First, it seeks to analyze the requirement of consultation with indigenous peoples in the international realm. Second, the study zooms in on Brazilian court practices by investigating particular cases regarding the requirement of consultation with indigenous peoples in the context of the exploitation activities. Thus, the analysis traces the legal developments in the Inter-American Human Rights System (IAHRS) and in the Brazilian legal system. In a deductive approach, will be analyzed doctrines, jurisprudence, international treaties and official data. This supports the broader objective to explore empirical facts and evaluates the evidence in context of theoretical considerations regarding the normativity and the effectiveness of the national and international courts as adjudicators. The work contributes to the theoretical understanding of the requirement of consultation under Brazilian legal system as considers practical ways on how to enforce domestic redress through court sentences for avoiding legal indeterminacy.
